Consular Processing


Consular processing is utilized when the applicant is outside the United States and wants to enter. The processing is completed at the United States Embassy. Consular visas are available for the following categories:

TOURIST VISAS – Finnegan & Diba does not represent individuals with simple tourist and/or visitor visas. Please apply at the US embassy on your own.

FIANCE VISAS – Visas are available for prospective spouses that will enable your loved one to enter the United States and marry inside the United States within 90 days of arrival.

MARRIAGE VISAS – Visas are available to enable spouses to enter the United States with lawful permanent resident status (greencard).

SIBLING PETITIONS (BROTHER & SISTER) – A visa petition may be filed to enable your brother or sister to enter the United States from outside the country if you are a U.S. citizen. Be aware that there is a lengthy delay in these sibling cases. Please discuss the feasibility for your family of this petition with our attorney.

PARENT PETITIONS - A visa petition may be filed to enable your parent to enter the United States from outside the country if you are a U.S. citizen. There is NO processing delay for parents of US citizens. Visas are NOT available for parents of LPR grenencard holders.

CHILD PETITIONS - A visa petition may be filed to enable your adult child to enter the United States. Minor children (under age 21) may also be petitioned but they have special rules and may qualify for derivative status.   Please consult with an attorney.   Be aware that there is a processing delay in petitions for adult children. Spouses and children under age 21 may be included in your petition for your adult child.

EMPLOYMENT PETITION – You may petition for workers outside the United States under several different visa categories. Please see the various visa categories available under section “Temporary & Permanent Visas).
